Whitepaper on Regulatory Implications for Cross-Border Data Transfers from China to the United States
This whitepaper summarizes privacy requirements related to the cross-border transfer of data from the People’s Republic of China to the United States of America.
Using research conducted in April 2018 with the assistance of a global law firm, this paper outlines the following regulatory compliance scenario: a Chinese financial institution transferring personal information or important data, furnished from local customers, cross-border to the US. This transfer would be structured either from the financial institution directly cross-border or through the use of a Chinese data service provider, as an intermediary. Key considerations include Chinese data protection and privacy laws, requirements and restrictions on data service providers (referred to as Network Service Providers), as well as details concerning under what circumstances a Security Self-Assessment must be performed.
